Welcome to MarsWork ("we," "us," "our," or "MarsWork"). We're glad you're here. By accessing or using our website at marswork.com (the "Site"), purchasing our products, downloading or using our software and firmware, or engaging with any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service (these "Terms").
If you do not agree with these Terms, we kindly ask that you refrain from accessing the Site, purchasing our products, or using our Services. If you are using the Services on behalf of an organization, please confirm that you have the authority to bind that organization to these Terms.
Quick Summary:These Terms describe the relationship between you and MarsWork as a customer and user of our 3D printing hardware, consumables, software, and community platforms. They outline what you can expect from us and what we kindly ask of you in return.

- "Products" refers to any 3D printer filament, accessory, or other physical good manufactured, distributed, or sold by MarsWork.
- "Open Source Software" refers to any third-party software licensed under an approved Open Source Initiative (OSI) license that is incorporated into or distributed alongside our Software.
- "User Content" refers to any 3D model file, print profile, image, text, review, forum post, or other content that you upload, publish, or share on or through our Services.
- "Community Platform" refers to any forum, model repository, profile-sharing system, social media group, or interactive feature operated by MarsWork where Users can post or share content.
- "Consumables" refers to materials consumed during the 3D printing process, including filament spools (PLA, PETG, ABS, TPU, etc.), photopolymer resins, and other printable materials.

3.1 Eligibility
To create an account or purchase Products from us, you need to be at least 18 years of age (or the age of majority in your jurisdiction). By registering, you confirm that you are legally capable of entering into binding contracts.
3.2 Account Information
We ask that you provide accurate, current, and complete information during registration and keep your account details updated. You are responsible for maintaining the confidentiality of your account credentials and for activities that occur under your account.

Please notify us promptly at marswork3d@outlook.com if you suspect any unauthorized use of your account or any security concern. While we will do our best to assist you, MarsWork is not responsible for loss or damage resulting from failure to report such issues in a timely manner.

4.1 Product Descriptions
We do our best to provide accurate descriptions, specifications, and images of our Products. However, we cannot guarantee that every product description, specification, or other content on the Site is entirely accurate, complete, or error-free. Minor variations in color, finish, or packaging may occur between displayed images and the actual Product you receive.
4.2 Pricing and Availability
All prices are listed in USD and EUR unless otherwise stated and may be adjusted from time to time. We may modify or discontinue any Product, and orders are subject to acceptance and availability. If a Product becomes unavailable after you place an order, we will notify you and offer a full refund or an equivalent alternative.
4.3 Order Acceptance
When you submit an order, it constitutes an offer to purchase. MarsWork may accept or decline any order at its discretion. An order is considered accepted when we send you an order confirmation email or ship the Products, whichever occurs first.
4.4 Technical Specifications
3D printing involves complex electromechanical systems. Published specifications (such as print speed, resolution, build volume, and layer accuracy) represent theoretical or engineering targets under controlled conditions. Actual results may vary depending on model geometry, material selection, environmental factors, and user configuration.
4.5 Currency and International Payments
All transactions on MarsWork are settled in US Dollars (USD). While prices displayed in Euros (EUR) or other local currencies on the Site reflect real-time exchange rate conversions for your convenience, your final billed amount will be processed in USD. Your card issuer or payment provider (such as Visa, Mastercard, or PayPal) will execute the final conversion into your local currency based on their prevailing exchange rates and applicable transaction policies at the time of settlement.

5.1 License Grant
Subject to your compliance with these Terms, MarsWork grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Software for your personal or internal business use with MarsWork Products. This license does not extend to sublicensing, distributing, selling, or incorporating our Software into third-party products without our prior written consent.
5.2 Updates
We regularly release Software updates, upgrades, patches, and new versions. Some updates may be important for the continued proper functioning of your Products. We may discontinue support for older Software versions over time. Please note that certain features may require the latest firmware version to function correctly.
5.3 No Reverse Engineering
We kindly ask that you refrain from reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of our proprietary Software, except to the extent that applicable law expressly permits such activities.

6.1 MarsWork IP
All content, branding, designs, firmware, software, documentation, and materials provided by MarsWork are the intellectual property of MarsWork or its licensors and are protected by applicable copyright, trademark, patent, and other intellectual property laws. The MarsWork name, logo, and all related marks are trademarks of MarsWork.
6.2 User 3D Models
You retain full ownership of any 3D model files, print profiles, and other content you create. However, by uploading User Content to our Community Platform, you grant MarsWork a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, store, use, display, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of operating and improving our Services and Community Platform.
6.3 No Infringement
Please ensure that any User Content you upload or share does not infringe the intellectual property rights, privacy rights, or any other rights of any third party. You are responsible for confirming that you have the necessary rights, licenses, or permissions to upload and share any User Content.

7.1 Content Standards
When posting or sharing User Content on our Community Platform, please refrain from uploading, posting, or transmitting:
- Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable;
- Content that infringes any patent, trademark, copyright, trade secret, or other proprietary right of any party;
- Content containing malware, viruses, or any code designed to disrupt or harm any system;
- Content containing instructions for manufacturing weapons, illegal devices, or items prohibited by applicable law;
- Content that collects or stores personal data of other users without consent.
7.2 Content Moderation
MarsWork may review, remove, or disable access to any User Content that we believe, in our reasonable judgment, violates these Terms or is otherwise inappropriate. While we are not obligated to actively monitor User Content, we may do so to help maintain a healthy and compliant community.
7.3 Print Profiles and Model Files
Print profiles and 3D model files shared on our Community Platform are provided by users "as is" without warranty. MarsWork does not guarantee that any shared profile or model will produce successful prints on your specific hardware configuration. Always verify slicer settings before starting a print.

8.1 Intended Use
MarsWork Products are designed for additive manufacturing (3D printing) of thermoplastic filaments, depending on the specific Product. We ask that Products be used in accordance with the included documentation, safety guidelines, and applicable laws.
8.2 Safety Warnings
Important Safety Information:
- Filament off-gassing: Some filaments (ABS, ASA, PC, nylon) emit volatile organic compounds (VOCs) and ultrafine particles (UFPs) when heated. We recommend ensuring adequate ventilation or using an enclosure with HEPA/activated carbon filtration.
- Fire safety: We recommend not leaving a 3D printer operating unattended for extended periods. Please use a smoke detector in the printing area and place the printer on a stable, non-flammable surface away from combustible materials.
8.3 Prohibited Uses
Please refrain from using MarsWork Products to:
- Manufacture firearms, weapons, or any item regulated, restricted, or prohibited under applicable law;
- Manufacture items that infringe the intellectual property rights of others;
- Manufacture items intended for medical, surgical, or life-critical applications where failure could result in bodily harm, unless the specific Product is certified for such use;
- Manufacture currency, identification documents, or security features;
- Modify the Product's safety systems, thermal runaway protection, or firmware in a manner that bypasses built-in safety mechanisms;
- Operate the Product in environments not suitable for electronic equipment (e.g., wet, explosive, or extreme temperature environments).
8.4 Modifications and Customization
The 3D printing community has a strong tradition of customization, and MarsWork supports responsible modification of our Products. However, please note that any modification to hardware, firmware, or software not officially approved by MarsWork will void the warranty and may introduce safety risks. You assume responsibility for any consequences arising from unauthorized modifications.

9.1 Third-Party Consumables
MarsWork 3D printers are designed to work with a wide range of third-party filaments and resins that meet industry-standard specifications (e.g., 1.75 mm diameter filament). While we do not prohibit the use of third-party consumables, we are unable to guarantee print quality, dimensional accuracy, or machine compatibility when using non-MarsWork materials.
Please be aware that using third-party consumables which do not meet published specifications (e.g., significantly oversized filament causing extruder jams, or resin with incompatible wavelength requirements) may damage your printer and will void the warranty for the affected components.
9.2 Material Properties
Published material properties (tensile strength, heat deflection temperature, impact resistance, etc.) are based on injection-molded test specimens manufactured under controlled laboratory conditions per ASTM/ISO standards. 3D-printed parts typically exhibit 60–85% of these values due to layer adhesion characteristics and anisotropic structure. Always conduct your own testing for critical applications.
9.3 Storage and Handling
Most 3D printing filaments are hygroscopic and will absorb moisture from the air, leading to print defects such as stringing, popping, brittleness, and poor layer adhesion. We recommend storing filament in a cool, dry place with desiccant, or in a sealed container with humidity below 15% RH. Resin should be stored in opaque containers away from UV light sources. MarsWork is not responsible for print failures or material degradation caused by improper storage.
9.4 Print Results
While we design our Products to deliver excellent print quality, we cannot guarantee specific print outcomes. Print quality depends on numerous variables including but not limited to: slicer settings, model geometry, material quality, ambient temperature, humidity, printer calibration, nozzle wear, bed adhesion method, and post-processing techniques.

10.1 What Is Covered
This warranty covers defects in materials and workmanship under normal use during the warranty period. If a defect arises during the warranty period, MarsWork will, at its discretion: (a) repair the defective component; (b) replace the defective component with a new or refurbished equivalent; or (c) issue a partial or full refund.
10.2 What Is Not Covered
- Damage caused by misuse, abuse, accident, or failure to follow operating instructions;
- Damage caused by unauthorized modifications, third-party firmware, or hardware alterations;
- Damage caused by using non-compatible or out-of-specification consumables;
- Damage caused by improper storage, transportation, or environmental exposure (moisture, dust, extreme temperatures);
- Cosmetic damage that does not affect functionality;
- Damage caused by force majeure events (fire, flood, lightning, power surges);
- Issues arising from user-assembled kit errors (for DIY/kit Products);
- Software issues caused by incompatible third-party slicer configurations or unsupported operating systems.
10.3 Warranty Claims
To file a warranty claim, please contact marswork3d@outlook.com with your order number, a description of the defect, and photos or videos demonstrating the issue. MarsWork may request additional diagnostic information or a remote troubleshooting session before approving a claim. Approved warranty repairs or replacements will be shipped at MarsWork's expense; we kindly ask that you cover return shipping of the defective item if requested.

11.1 Return Eligibility
Unused Products in their original packaging may be returned within 30 days of delivery for a full refund, subject to the conditions below. Products should be in resalable condition with all accessories, documentation, and packaging intact.
11.2 Non-Returnable Items
- Opened filament spools;
- Custom or personalized Products;
- Software licenses or digital downloads;
- Clearance or final-sale items.
11.3 Return Process
Please contact marswork3d@outlook.com to obtain a Return Merchandise Authorization (RMA) number before shipping any item back. Returns sent without an RMA number may be declined. Return shipping costs are the customer's responsibility unless the return is due to a MarsWork error or a confirmed product defect.
11.4 Refund Processing
Approved refunds will be processed within 5–10 business days of receiving and inspecting the returned Product. Refunds will be issued to the original payment method. Shipping charges are non-refundable except where required by law.

To the fullest extent permitted by applicable law, MarsWork, its directors, officers, employees, affiliates, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, business interruption, property damage, personal injury, or other damages arising out of or related to the use of our Products or Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if MarsWork has been advised of the possibility of such damages.
12.2 Monetary Cap
MarsWork's total aggregate liability for any claim arising out of or relating to these Terms or our Products or Services is limited to the amount you paid to MarsWork for the specific Product or Service that is the subject of the claim, or USD $100, whichever is greater.
12.3 Essential Basis
The limitations and exclusions in this section reflect a reasonable allocation of risk between you and MarsWork and form an essential basis of the agreement between us. Without these limitations, MarsWork would not be able to offer its Products and Services at the current prices.
Consumer Protection Notice:Some jurisdictions do not allow the exclusion or limitation of certain damages or liability. If you are a consumer in such a jurisdiction (e.g., EU, UK, Australia), the above limitations apply only to the extent permitted by applicable mandatory consumer protection laws.

You agree to indemnify and hold harmless MarsWork, its affiliates, and their respective directors, officers, employees, and agents from claims, liabilities, damages, losses, expenses, and costs (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our Products or Services in violation of these Terms or applicable law;
- Your User Content, including any claim of intellectual property infringement;
- Any unauthorized modifications you make to our Products;
- Any products you manufacture using MarsWork Products that cause harm to third parties;
- Any breach of your representations or warranties under these Terms.

14.1 Print Data and Model Files
When you use our cloud-based slicing or remote printing features, your 3D model files and print profiles may be transmitted to and temporarily stored on our servers solely for the purpose of processing your request. We do not claim ownership of your model files and will not access, use, or distribute them except as necessary to provide the requested service or as required by law.

Our Site and Software may contain links to third-party websites, services, or marketplaces (e.g., 3D model repositories, slicer software, filament suppliers) that are not owned or controlled by MarsWork. We are unable to take responsibility for the content, accuracy, practices, or policies of any third-party site or service. Please review their terms and privacy policies when visiting third-party sites.
MarsWork Products may be compatible with third-party software (such as Cura, PrusaSlicer, or other open-source slicers). While we strive to maintain compatibility, we cannot guarantee uninterrupted compatibility with any specific third-party software version.

16.1 International Shipping
MarsWork ships Products internationally. Please note that customs duties, import taxes, VAT, and any other fees imposed by the destination country are the responsibility of the customer. Shipping times for international orders may vary based on customs processing and local logistics.

We ask that you comply with all applicable export control laws and regulations, including but not limited to the U.S. Export Administration Regulations (EAR), EU dual-use regulations, and any applicable sanctions programs. You confirm that you are not located in, under the control of, or a national of any country subject to comprehensive sanctions, and that you are not on any restricted party list (e.g., U.S. Treasury OFAC Specially Designated Nationals list, U.S. Commerce Department Entity List).

Our Products are designed to comply with applicable safety and electromagnetic compatibility standards, including CE, FCC, and RoHS where applicable. Regulatory certifications may vary by product model and destination market. We recommend verifying that the specific Product complies with your local regulations before purchase and use.

MarsWork may update these Terms from time to time. If we make material changes, we will notify you by email (if we have your email address) or by posting a prominent notice on the Site at least 30 days before the changes take effect. Your continued use of our Products or Services after the effective date indicates your acceptance of the updated Terms.
If you do not agree with the modified Terms, you may discontinue using our Services and, if applicable, request a refund in accordance with our return policy. MarsWork is not responsible for any loss or damage resulting from failure to review updated Terms.

MarsWork may suspend or terminate your account and access to our Services if we believe you have violated these Terms or applicable law, or if your actions may cause harm to MarsWork, other users, or third parties. We will make reasonable efforts to provide notice where circumstances permit.
Upon termination, all licenses granted to you under these Terms will immediately cease. 19. Dispute Resolution and Arbitration
19.1 Informal Resolution
Before initiating formal dispute resolution, we encourage both parties to attempt in good faith to resolve any dispute through direct communication. Please send a written notice of the dispute to marswork3d@outlook.com with a detailed description of the issue and the relief sought. We will respond within 30 days.
19.2 Binding Arbitration
If the dispute cannot be resolved informally within 60 days, it will be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and the seat of arbitration will be the state or federal courts nearest to MarsWork's principal place of business, unless you are a consumer residing outside the United States, in which case the seat will be determined in accordance with AAA International Arbitration Rules.
19.3 Class Action Waiver
You and MarsWork agree that each party may bring disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
19.4 Exception: Small Claims Court
Either party may bring a claim in small claims court for disputes within that court's jurisdiction, in lieu of arbitration.

Notwithstanding the above, MarsWork may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights or address imminent harm at any time.

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
For customers residing in the European Union or the United Kingdom, these Terms shall be governed by the laws of the jurisdiction in which you received the Product, to the extent required by mandatory consumer protection provisions. In such case, the dispute resolution provisions in Section 20 shall apply to the extent they do not conflict with your mandatory statutory rights.

21.1 Entire Agreement
These Terms, together with our Privacy Policy, Warranty Policy, and any other policies referenced herein, constitute the entire agreement between you and MarsWork regarding the use of our Products and Services.
21.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
21.3 No Waiver
The failure of MarsWork to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of MarsWork.
21.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without MarsWork's prior written consent. MarsWork may assign these Terms without restriction.
21.5 Force Majeure
MarsWork is not liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure is caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, civil unrest, government actions, labor disputes, supply chain disruptions, or raw material shortages.
21.6 Electronic Communications
You consent to receive communications from MarsWork electronically, including via email, SMS, or in-app notifications. These electronic communications satisfy any legal requirement that communications be in writing.
21.7 Language
These Terms were originally drafted in English. Any translated version is provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall control.
